The name was changed in 2012 following <a href=\"https:\/\/openparliament.ca\/bills\/42-1\/C-93\/\">legislation<\/a> introduced by the Conservative government under Stephen Harper.<\/p>\n<p>The program is run by the <a href=\"https:\/\/www.canada.ca\/en\/parole-board\/services\/record-suspensions.html\">Parole Board of Canada<\/a> and allows someone who has been convicted of a crime to have the criminal record removed. This allows people who have paid their debt to society to continue in life without the stigma of a criminal record. \u00a0Most notably it allows for job applicants to perform <a href=\"https:\/\/nationalpardon.org\/fingerprinting\/\">criminal record background checks<\/a>[\/vc_column_text][\/vc_column][\/vc_row][vc_row row_container=&#8221;true&#8221;][vc_column][vc_custom_heading text=&#8221;Who can apply for a Record Suspension?&#8221; font_container=&#8221;tag:h2|font_size:20px|text_align:left|line_height:24px&#8221; use_theme_fonts=&#8221;yes&#8221; custom_style=&#8221;letter-spacing: -0.075em;&#8221;][vc_column_text]Anyone in Canada who has been convicted of a crime can eventually apply for a record suspension. The applicant must satisfy all court demands then wait a certain number of years before becoming <a href=\"https:\/\/nationalpardon.org\/pardon-eligibility\/\">eligible to apply for a record suspension.<\/a><\/p>\n<p>During the waiting period which is either 3, 5 or 10 years (depending on the type and the severity of the crime) anyone applying for a pardon must have stayed out of trouble with the law. Most notably, anyone with charged with a crime of sexual nature that involves a minor is not eligible for a record suspension.<\/p>\n<p>Anyone who has been convicted of 4 or more crimes and sentenced to more than 2 years in prison for each occurrence is not eligible for a record suspension.[\/vc_column_text][\/vc_column][\/vc_row][vc_row row_container=&#8221;true&#8221;][vc_column][vc_custom_heading text=&#8221;How to apply for a Record Suspension?&#8221; font_container=&#8221;tag:h2|font_size:20px|text_align:left|line_height:24px&#8221; use_theme_fonts=&#8221;yes&#8221; custom_style=&#8221;letter-spacing: -0.075em;&#8221;][vc_column_text]Applying for a record suspension is a length and time consuming process although it is possible to apply on your own through the Parole Board of Canada. There are 9 steps required to successfully complete a record suspension application. These include:<\/p>\n<ul>\n<li>Step 1 \u2013 Get your Criminal Record<\/li>\n<li>Step 2 \u2013 Get your Court Information<\/li>\n<li>Step 3 \u2013 Get your Military Conduct Sheet<\/li>\n<li>Step 4 \u2013 Get your local police record check(s)<\/li>\n<li>Step 5 \u2013 Get a copy of your document to support your identity<\/li>\n<li>Step 6 \u2013 Complete the Schedule 1 &#8211; Exception Form<\/li>\n<li>Step 7 \u2013 Fill in the Record Suspension Application Form<\/li>\n<li>Step 8 \u2013 Complete the Measurable Benefit\/Sustained Rehabilitation Form<\/li>\n<li>Step 9 \u2013 Provide the Payment of the Application Processing Fee<\/li>\n<\/ul>\n<p>The complete application process can be viewed here:<\/p>\n<p>https:\/\/www.canada.ca\/en\/parole-board\/services\/record-suspensions\/applying-for-a-record-suspension.html[\/vc_column_text][\/vc_column][\/vc_row][vc_row row_container=&#8221;true&#8221;][vc_column][vc_custom_heading text=&#8221;How long does it take to get a Record Suspenion?&#8221; font_container=&#8221;tag:h2|font_size:20px|text_align:left|line_height:24px&#8221; use_theme_fonts=&#8221;yes&#8221; custom_style=&#8221;letter-spacing: -0.075em;&#8221;][vc_column_text]The process to obtain a record suspension in lengthy and time consuming. Furthermore, it also must be done in a specific order so that certain documents do not expire before the application is complete.<\/p>\n<p>While it is impossible to provide exact time frames for obtaining a record suspension, we are can provide averages based on our operating experience.<\/p>\n<p>A typical record suspension application will take approximately 1 years to complete. This assumes that the applicant is currently eligible or soon will be.<\/p>\n<p>Although we normally see applications completed with a year of starting it is possible for some cases to be done in as little as 6 months. It will indicate the same information as if the individual had never been arrested to begin with, specifically that there is no information to report.<\/p>\n<p>A record suspension can also help people who wish to volunteer in their community. Instead, it is set apart from the main repository of criminal records.
