Get a Pardon for a DUI – The Most Common Charge

There are many names for a DUI. But whichever you choose you should know that it is the most commonly pardoned criminal conviction in Canada. The chances are good that you will be familiar with at least one or two of them. But whatever you want to call it the charge is the same and it involves operation of a motor vehicle while intoxicated by alcohol or drugs or anything else that impairs your judgement or dexterity.

It could even just be cough medicine because if you are driving under the influence of anything you are breaking the law. This includes impair

DUI in Canada

In Canada a DUI arrest is taken very seriously. In our experience it is almost unheard of to be found not guilty of a DUI.

Interestingly the first arrest for a Canadian citizen for driving under the influence of alcohol goes all the way back to 1920 in the case of R. v. Nickle. Although in this case the detais appear to be more serious that simply driving drunk since it was established that the act of driving intoxicated would support a manslaughter conviction.

Alcohol Limits for a DUI Charge

Generally speaking a blood alcohol limit of .08 is the threshold where a DUI arrest will be made. However, if the subject being tested is close to the limit, but not over, the police have various options regarding enforcement. Those options vary from province to province.

Going to Court for an impaired Charge in Canada

In our experience it is extremely uncommon to be ground not guilty of a DUI charge in Canada. One of the things that makes it such a difficult charge to fight is that – by definition – you were impaired and therefore any testimony you provide immediately lacks credibility. This makes sense. A sober police officer performing his or her job while administering a breathalyser test has a lot more credibility than a drunk person charged with operating a motor vehicle. If you are charged for a DUI in Canada do not expect to be found not guilty. Although it’s certainly possible, it is highly unlikely.

Sentencing for a drunk driving charge

  • For a first offence, a $1000 fine and a 12-month driving prohibition,
  • For a second offence, 30 days of jail and a 24-month driving prohibition, and
  • For a third or subsequent offence, 120 days of jail and a 36-month driving prohibition.

From province to province there are slight variations on the sentencing involved for a DUI charge in Canada but the above is a good general guideline. The most common element is that a DUI conviction in Canada will certainly result in 1 year license suspension following your first conviction as well as a fine.

Does a DUI show up on a background check in Canada?

Whenever you are convicted of a crime in Canada the record will show up during any background check. Even if you are not found guilty there are records of the arrest that can easily be viewed by employers and other interested parties.

If you have a DUI conviction – or even i you have only been arrested for a DUI but not found guilty – you should apply to have your record removed.

Non conviction

If you were not convicted following a drunk driving arrest you should apply for a purge and file destruction.

Conviction

If you were convicted for your arrest you need to apply for a pardon.

Getting a pardon or file destruction for a Drunk driving charge

If you think you will want to eventually obtain a pardon for your DUI charge the first thing you should do after being convicted is pay your fine. For the purpose of your pardon the sentence being considered will almost invariably be the fine you receive provided there was no jail time involved.

For whatever reason, the license suspension is not considered a part of the sentence during the pardon application. So it is conceivable that you could have your criminal record sealed but never bother getting your license back.

If you decide to apply for a pardon for a DUI charge you will want to make sure you have no traffic violations of any kind during the eligibility waiting periods as they can be used against you during the review process. But provided you meet the eligibility criteria and you satisfy the good conduct clause you will be able to seal your criminal record and remove that DUI charge once and for all.

  2. Yes. A pardon will clear your DUI conviction. As for licensing I am not sure what kind you are referring to so I cannot say for sure. If it is just a driver’s license you will certainly be able to get that.

    If I successfully receive a pardon for my DUI conviction, would my car insurance rates be back to the rates prior to conviction.

  4. Insurance is a tricky one. It varies from province to province and between insurance companies. I don’t think I could give you a definitive answer on that one I’m afraid.

    So here is my dilema on Jan 01-2006 i was arrested for DUI. I went to court and pleaded guilty to careless driving and paid a fine of $500.00. I just got offered a new job and my fingerprints have been sent to the RCMP for a background check. I think this careless driving might still be on my record and jepordize my new job. How do i go about getting it remove.

    Hello Michael, so am I right to say that even if you’ve satisfied everything required by the courts, one must still wait 5 years before a record suspension would even be considered? There are no exceptions at all? I’m not complaining here, just want the facts, since some sites offering to help with a pardon make it sound that the Parole Board might consider a pardon if you’ve met all conditions and depending on the gravity of the offense/charge. I just want 100% clarification, since my charge was just last year (2011), and I paid my fine in full just this year (May 2012) I believe. So that would mean I need not bother applying for a pardon before 2017, if they even allow them anymore by then?

    The rules and regulations in the next 5 years should not be changing again but yes according to the new rules you now have to wait a minimum of five years before applying for a pardon/record suspension after your sentence has been completed. Anyone who says they can get it faster is incorrect. You should start your application a minimum of one year before your eligibility date.

    Hello, so to ask this again as I did way back in 2011 if I was able to get a pardon this would hide my convictions and I would be able to obtain a drivers license back? Im in nova scotia have 4 DUIs from 2000 all within one year, So a pardon would hide my records and Registry of motor vehicle would give me my License back even though the somewhat operate outside the canadian criminal code and make up there own sentencing if convicted? thanks

      I am not an expert on motor vehicle law for the various provinces but I believe there is nothing stopping you from getting your license unless the court ordered it suspended indefinitely. I think the real question for you will be insurance. But again this is a little bit outside my area of expertise.

    I got arrested for a DUI a couple days ago, haven’t had my court date yet but if lose my license for a year, it will severely affect my job, so I was thinking of using that time to travel and knock some things off my bucket list, will a DUI restrict me from leaving or stop me from getting into other countries? I figure I wouldn’t be able to drive out of the country but so e friends had told me I wouldn’t be able to leave at all until after the potential one year

      DUI isn’t a problem travel wise, provided it’s the only thing on your record and there is only 1. I would probably stay away from the States myself but that is being uber careful to be honest. Any other country in the world is not a problem.

    I live in Ontario, got a DUI back before the Ignition lock laws were in place, got a second DUI 4 years later. Is now 10 Years since i had an active driver’s license and they are trying to lump the two together saying i need the device for 3 years. Plus because of the time i have gone without renewing my license they want me to start over with the G graduated system. Is there a time limit? or are they just trying to get me to apply so they can cash in?

      I am afraid this is a situation I have never dealt with before and it’s not exactly related to a criminal record directly so I’m reluctant to answer you. However, if it were me and I was being told to go to graduating licensing I would most likely raise a bit of a fit. You are renewing your license rather than applying for the first time. But I’ve no idea what the law would say on this issue.

      Basically to answer your question the DUI will never go away until you make the application for a pardon. As for the second DUI so long as you are eligible and you make the application both charges would be removed with the same application.

      Each province has its own rules and regulations regarding driving related incidents. I would suggest contacting your department of motor vehicle for more information.

      In Quebec, the information is held for 10 years but following a pardon a special request can be submitted to remove the information prior the 10 year mark.

  21. I would like to travel to the usa. I have had 2 dui cinvictions, 1, 20 yrs. ago, and the second 10 yrs. ago. I know people that have dui convictions that haven’t gotten pardons and have travelled there with no problems, multiple times, how can this be? I am also wondering what the difference between a pardon and a waiver is?

      Normally DUI is the one charge the Americans are not concerned with. The problem is that you have more than 1. Whenever there is more than 1 charge they are supposed to require that you obtain a waiver. I suggest you get your pardon done and stay away from the border.     I received a DUI August 2010 it was my first & only offence. I lost my license which caused me to lose my job at a car dealership. I paid my fine of $1000, took the Back on Track course and had the Breathing Interlocking club on my car for a year which had to be calibrated once a month 50 miles away at a cost of $90.00 per month. My insurance tripled. I waited 3 years to apply for a pardon in September 2013 & have waited patiently only to be told today I now have to wait 5 years for a pardon. So I can’t get a pardon until September 2015 & hopefully I can get my life back in order. What an unjust country we live in. Thank God I have a supporting family.

      I understand your frustration but its the government that is unjust. Canada is one of the very few people with a program like this to eliminate criminal records. In many other countries it simply wouldn’t be an option.

      The Tories have no business meddling in matters of criminal justice (imho). It was a shame they were able to obtain a majority.

    I have just been granted a pardon through Pardons Canada. I got a DUI in 2008, loosing my license for 1 year, but being rated a high risk to reoffend (making it mandatory to have a breathalyzer in my vehicle if I wanted to drive after the 1 year suspension). My Nova Scotia drivers license expired in 2009 (more than 3 years ago), so I will have to be retested regardless, but I am wondering the steps I take in getting my drivers license back and legally getting back into a vehicle.

    Will this effect insurance if I haven’t had insurance since 2008 and I switch to a different company? (I assume I do not need to tell them about my DUI because I have been pardoned).

    If I go to the DMV and get retested etc, will there be any record attached to my past licensing? Or will I be able to purchase a vehicle, get insured and drive away legally.

  27. i had a dui over 25 yrs ago and would like to get a fast card, i am a trucker but do not know if i can apply without getting a pardon first , i have a passport will that help or does that not matter, is there a time limit on criminal records Ive not had an issue since then. any info would help, i crossed the border lots back about 12 yrs ago and had no issue and the US border patrol had asked for my ID on several occasions and was never denied access .

      The Americans don’t seem to care about a single DUI charge but that being said it won’t help your application for a fast card. My advice would be to get the pardon anyway. Seeing as you are a driver by profession it would make sense to take that blemish off your record.

So I got a DUI back in 1988, I got $500.00 fine, 6 months suspension of my DL…I applied for a Pardon in 1992, got it, but this DUI still shows up, and now there is no record of me applying for a Pardon as according to Parole Canada…Unless I have proof that I sent the Application nothing they can do, it was a free service back then, now I may have to pay the fee of $631.00? I am at a loss?

  29. Hello,

    I had a DUI in December 2006. I was convicted in September 2008, and I started the process of applying for a pardon last year. I was arrested for another DUI on January 1, 2016. Is there a limit to the amount of time that has passed between convictions (will the first conviction factor in since it was 9 years ago)? The reason I ask is because there is a minimum 30 days of jail time for the second conviction and I’m extremely worried. If I get a pardon will they count it as my first offence?

  31. Hello,

    My partner received a DUI over 15 years ago and got a pardon for it. He is considering moving to the US to work (we are Canadian). He has been to the States many times and never been stopped or questioned. Will a new employer be able to see the DUI on his record when they do a criminal check even though it has been pardoned? Basically, we are not sure if pardons are applicable in the US or not.

  41. I reside in Edmonton. I received a curative discharge in 2015. I am on probation until Sept/17. I received a 5 year suspension. As per the judge, I am eligible for Interlock Ignition program. Will my insurance go sky high even with a discharge? When can I start the Interlock program and for how long?

    If I get a pardon do I still have to use the blower ignition system when I do get my license back? I’m basically avoiding driving at the moment because I don’t want to pay for that system, I’d rather wait 4 more years and get a pardon if possible.

      I’m not really an expert on the ignition systems in these cases but I believe that it’s only in the event you don’t want to wait until the license suspension is completed. Once that suspension is over I believe that the ignition system is not rquired so you could be driving well before you would receive a pardon.

  46. hello, I was convicted in 2013 for a dui and paid the fine in 2015 as i was not aware the fine would play a major part in the pardon process. Now, will I have to wait 5 years from the time i paid the fine to be eligible for a pardon which would be 2020? Or can i apply for a pardon in 2018…I did not pay the fine in 2013 or 2014 because i had chosen to appeal the conviction and after i lost the appeal, i paid the fine.

  47. I was charged for DUI under drug act, At time I was sleeping in my car when charged. Car was running but parked. I need my license to keep working in my work now. I have worked so hard to get where I am now. And one stupid mistake lead to this. I Had a bad drug problem and have gone to rehabs to try to stay clean. I checked myself into rehab, immediately post this and have been in rehab 5 months in BC now, but my family lives in Manitoba. i was sent to BC because of rehab shortages. Was doing great but I have hard time coping when things don’t go well, I left rehab to use. I relapsed but did not drive said vehicle at time of using. Because I had no where to go, I slept in car to stay warm. Now I have this court date hovering over me, I have moved back to Manitoba this past month because my rehab is done in BC. But should I go back to court there, or can I have court moved here or should I just leave it and let what happens happen!. I can’t afford to hire a lawyer. Stressing here, trying to keep it together. Been clean since then..Scared Straight..very worried this might put me over! Will I never get my license back? How long will this affect me? What should I do, Anyone??? Help?? Will I ever be able to travel through usa, or how long will I have my license suspended if convicted, do I get convicted if I moved. I checked with court and police and ICBC before moving…they said there was nothing showing. Not to worry now I see a court charge on docket, I check daily . Can I get a pardon? how long do I have to wait? Need direction, no lawyer will talk to me without money first!

      DUI’s are not a problem. The cost is $695 for our service + $631 to the Parole Board of Canada + about $75 to your local police station depending on where you live.
